1. Agreement to Terms
By accessing or using TheBuildingCloud platform ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you may not access the Service.
2. Description of Service
TheBuildingCloud is a comprehensive smart building management platform that provides:
- Access control and entrance management systems
- CCTV monitoring and video surveillance
- Parking management and ANPR (Automatic Number Plate Recognition)
- Meeting room booking and management
- Video intercom systems with mobile app support
- Fire alarm and burglar alarm monitoring
- IoT device management and control
- Automation workflows and smart building rules
- Issue reporting and ticketing system
- Analytics and reporting tools
3. Account Registration
3.1 Account Creation
To use our Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

4. Subscription and Billing
4.1 Subscription Plans
Paid subscriptions are billed on a monthly or annual basis in advance. Annual subscriptions receive a discount equivalent to 2 months free.
4.2 Metered Usage
Certain features may incur additional charges based on usage, including but not limited to:
- Additional PIN/PROX/UHF ID/QR codes (£0.10 each/month on Enterprise)
- Extra Caller ID users (£0.10/month on Enterprise)
- Intruder alarm monitoring (£3–£10/alarm/month depending on plan)
- Fire alarm monitoring (£25–£35/alarm/month depending on plan)
- Unlimited SIM cards (£7/month per device on Free plan)
4.3 Payment Terms
Payment is due at the start of each billing period. Failure to pay may result in service suspension or termination. All fees are non-refundable except as required by law or as explicitly stated in these Terms.
4.4 Price Changes
We reserve the right to modify our pricing with 30 days' notice. Existing subscribers will be notified via email before any price changes take effect.
5. Acceptable Use Policy
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Transmit malicious code or viruses
- Attempt unauthorized access to our systems
- Interfere with or disrupt the Service
- Use the Service for any illegal or unauthorized purpose
- Harass, abuse, or harm another person
- Impersonate any person or entity
6. Data and Content
6.1 Your Data
You retain all rights to your data. By using our Service, you grant us a license to use, store, and process your data solely for the purpose of providing the Service.
6.2 CCTV and Recording Data
You are responsible for ensuring that your use of CCTV cameras, video recording, and audio recording complies with all applicable privacy laws and regulations. You must provide appropriate notices to individuals who may be recorded.
6.3 Data Backup and Storage
While we implement backup procedures, you are responsible for maintaining your own backups of critical data. We are not liable for any data loss.
7. Service Availability
7.1 Uptime Guarantee
We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service. Planned maintenance will be scheduled during off-peak hours when possible.
7.2 Service Modifications
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
8. Intellectual Property Rights
The Service, including its original content, features, and functionality, is owned by TheBuildingCloud and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
9. Third-Party Services and Integrations
Our Service may integrate with third-party services including:
- TUYA Smart Devices
- Payment processors (Chargebee)
- SMS providers (Twilio, Vonage)
- Cloud storage providers
- Calendar services
Your use of third-party services is subject to their respective terms and conditions.
10. Limitation of Liability
To the maximum extent permitted by law, TheBuildingCloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the Service
- Any unauthorized access to or use of our servers and/or any personal information stored therein
- Any interruption or cessation of transmission to or from the Service
- Any bugs, viruses, trojan horses, or the like that may be transmitted through the Service
- Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service
11. Indemnification
You agree to indemnify, defend, and hold harmless TheBuildingCloud and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Your use of CCTV, recording devices, or access control systems in violation of applicable laws
12. Termination
12.1 Termination by You
You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period.
12.2 Termination by Us
We may terminate or suspend your account immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
12.3 Effect of Termination
Upon termination, you will have 30 days to export your data. After this period, your data may be permanently deleted. All provisions of the Terms which by their nature should survive termination shall survive.
13. Warranty Disclaimer
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
14. Compliance with Laws
You are responsible for ensuring that your use of the Service, including the deployment of CCTV cameras, access control systems, and recording devices, complies with all applicable local, national, and international laws and regulations, including but not limited to:
- Data protection and privacy laws (GDPR, etc.)
- Surveillance and recording laws
- Building safety regulations
- Fire safety codes
- Employment laws
15. API and Webhook Usage
If you use our API or webhook features:
- You must comply with our API usage guidelines
- You are responsible for securing your API keys
- We may impose rate limits to ensure fair usage
- We reserve the right to revoke API access for abuse
16. Service Level Agreement (SLA)
Our target uptime is 99.9%. In the event of extended outages exceeding our SLA commitment, Enterprise customers may be eligible for service credits as outlined in their subscription agreement.
17. Support and Maintenance
Support levels vary by plan:
- Forever FREE: Community support and documentation
- PRO: Email support with priority response
- Enterprise: 24/7 phone support with dedicated account manager
18. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
19. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
20. Dispute Resolution
Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiations. If unresolved, disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
21. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.
22. Entire Agreement
These Terms constitute the entire agreement between you and TheBuildingCloud regarding the Service and supersede all prior agreements and understandings.
